1. Introduction
In Australia a Jewish community group brought a legal case against a “Muslim hate preacher” under section 18C of the Race Relations Act. He gave a number of sermons part of which contained vile antisemitic tropes about Jewish people. Clearly hate speech. I agree. Open and shut case.
But a huge legal precedent was set. And those bringing the case realised too late after the Judge’s detailed ruling that they’d shot themselves in the foot.
2. 🇦🇺 ECAJ v Haddad 2025: A legal precedent
The case was brought by the Executive Council of Australian Jewry (ECAJ) v Wissam Haddad1.
The cleric seems to be a fairly unhinged individual and had ranted on several topics including indisputably vile racist tropes about Jewish people which were antisemitic and he was rightly found guilty of (“imputation established”).
However he said a lot more. And that wasn’t antisemitic.
2.1 Key Definitional Points
“not all Jews are Zionists or support the actions of Israel in Gaza…”
“disparagement of Zionism constitutes disparagement of a philosophy or ideology and not a race or ethnic group”
“political criticism of Israel, however inflammatory or adversial, is not by its nature criticism of Jews in general or based on Jewish racial or ethnic identity”
The above seem obvious …. but this Judge’s definitional ruling is the exact opposite of what pro-Israel lobby groups Australia have been arguing for 21 months….
I personally found the antisemitic parts of Haddad’s speeches to be vile and repulsive and he deserved to be found guilty.
But the base points he made were not just clearly not antisemitic as the judge has ruled but also common talking points in the protest against Israel and its institutional supporters - even if put extremely strongly.
2.2 Points deemed not antisemitic
The following are direct quotes from Haddad in the context of the Judge’s ruling and not found to be antisemitic (whether agreed with the statement or not):
“certain media outlets owned ... by the Zionist entities are trying to sway public perception”
“Zionist backed media agencies” dragged him [Haddad] and the Centre “through the mud”
the media that are owned by “the Zionists” will always push the narrative that the Israelis have done nothing wrong and that it is always the Muslims of Gaza who have done wrong and who deserve to be killed.
Judge: again there is nothing in what Mr Haddad says there that would be understood as a reference to Jews generally. He is talking explicitly about Zionists
“right wing politicians have stepped into backing Israel because Israel holds their leash”
“the terrorist state of Israel and its mass murdering machine, the IDF”
“a time in the future when Palestine is “cleansed from the filth of the Zionists”
Judge: “the context is the Israeli occupation of Palestine, in particular Gaza. Mr Haddad is speaking to a time in the future when Palestine is no longer occupied. That is not about Jews”
2.3 Collectivisation
He also touched on something that has always bothered me.
“The conclusion that it is not antisemitic to criticise Israel is the corollary of the conclusion that to blame Jews for the actions of Israel is antisemitic; the one flows from the other”
It is hypocritical and quite frankly irresponsible for ECAJ and other community groups to:
claim to be the voice of the whole Australian Jewish community
adopt the IHRA definition of antisemitism that “holding Jews collectively responsible for the actions of the State of Israel” to be antisemitic (which it indisputably is whether or not you proscribe to the IHRA definition)
take and actively advocate an international policy platform that mirrors that of the State of Israel….
… which effectively puts your community in line for criticism of Israel’s actions whether they like it or not.
And by that logic - criticising someone’s stance in Australia in supporting the policies of the State of Israel would be deemed antisemitic … which is it not.
Perhaps this could be a legal angle that moderate and progressive Jewish groups in Australia could take - effectively an “opt out” of the indisputably biased management of such groups keen to collectivise and in whose interest a perception of antisemitism seems important to keep in the public eye.
Appendices B,C and D list out some of the progressive antizionist Jewish voices and groups, many of whom are in Australia, contrary to the “representative” community groups collectivising them.
3. 🇬🇧 Miller v Bristol University 2024: A tribunal precedent
In February 2024 an Employment Tribunal in the UK gave the same essential ruling in favour of UK Academic David Miller2.
He was sacked from Bristol University over antisemitism complaints after he produced an academic critique and study of zionism calling for its dismantling based on the evidence of injustice he had provided.
The Tribunal ruled that taking the position of anti-Zionism was a “protected characteristic” and therefore Miller was unfairly sacked.
Whilst not a court of law it was an important milestone ruling for clarity.
4. 🇺🇸 Anti-Zionism v antisemitism: Tishby v Foster
After legal rulings - the court of public opinion - or trial by social media. This is an example of public discourse between Jewish Americans on anti-Zionism v antisemitism.
On Mar 5 2025 prominent pro-Israeli Noa Tishby posted herself at a panel discussion giving an impassioned plea why anti-Zionism is antisemitism.
A few hours later a Jewish American professor tweeted a comprehensive rebuttal backed with factual data3. It is worth reproducing his response here in full to review the arguments of why the two are different.
Hi Noa Tishby,
I'm Jewish. Many of my closest friends are Jewish. I love them all. My whole family is Jewish, I love them all too. My community is Jewish. Love them all. I love Judaism. I host shabbat dinners, celebrate Jewish holidays, sing Jewish prayers, study Torah & Talmud, and love Jewish culture, history and expression.
But I'm not a Zionist. Zionism was an ideology that said, let's create a Jewish state in a country that's 90%+ non-Jewish.
That's why, when Zionists bought land in Palestine from the 1900s-1948, they uprooted the people living on the land because they weren't Jewish.
That's why, when Zionists created cooperatives in Palestine in the 1910s, 1920s and 1930s, they insisted on "Hebrew Labor", i.e., "Jews only" -- no Arabs allowed.
That's why, in the 1930s, Zionists expelled Palestinian Arabs from working at Jewish companies and business. (Think "whites only", but with the Zionists it was "Jews only.")
That's why, in 1948, Zionists militias ethnically cleansed 750,000 Palestinians from their homes.
That's why, from 1949-1956, Israeli forces shot & killed b/w 2,700-5,000 overwhelmingly unarmed Palestinians trying to return to their homes after the war. Because they were the wrong religion/ethnicity (source: Benny Morris, Border Wars, p.416). The Zionists wanted to create a Jewish State with a Jewish majority, and there were simply way too many Palestinians that would have been incorporated into the borders of the new state, so they had to go, they had to be expelled. The ideology created the incentives, the incentives created the outcome.
That's why the state of Israel uprooted & ethnically cleansed another 30-40,000 Palestinians from the borders of the newfound state from 1949-1959, because those people were of the incorrect religion/ethnicity, thus rendering them an inherent threat to the state because they didn't have J-positive blood (source: https://palestinenexus.com/articles/israel-ethnic-cleansing-1949-1965). Zionism was a political ideology that insisted on Jewish control, Jewish domination, Jewish supremacy in a land of mostly non-Jews, in a land of mostly Palestinian Arabs.
That's why Israel has become such a pariah state over the years, because it's insistence on Jewish rule in a country with so many non-Jews.
That's why Zionism has led Israel to become an apartheid state, according to every relevant human rights organization (@ICAHD in 2010, @UNESCWA in 2017, @YeshDin in 2020, @AdalahCenter in 2020, @btselem in 2021, @hrw in 2021, @fidh_en in 2021, @alhaq_org in 2022, @Addameer in 2022, @AlMezanCenter in 2022, @cacalqudsuni in 2022, @AdvocacyJlac in 2022, @miftahpal in 2022, @ICJ_org in 2022, @DAWNmenaorg in 2022), because Israel gives Jews extra rights & extra privileges over the native non-Jews in Israel, the West Bank and Gaza.
Obviously it does. that's the point of Zionism. Zionism also explains why Israel is now committing genocide, because, what a Zionist dream it would have been had Palestine been a land without any people on it! The ideology incentivized genocide.
So, please don't conflate my Jewish identity -- that has existed for 3,300+ years -- with your toxic, anti-Jewish values-political-ideology -- that has existed for less than 150 years. Judaism will last as long as their are humans on the planet. Zionism is imploding in real time.
One last point. Historically, you were much more likely to be a Zionist if you were antisemitic. Zionists and antisemites have had and still have much in common, it's why today's antisemites are Israel's greatest allies.

6. One for the protestors
Back to the judgement in Australia.
The real winners here in an environment of more and more suppression of Palestinian voices - are Australian pro-Palestine protesters.
The reason this judge’s definitions are absolutely key is that the management of the “community groups” have effectively been barracking for Israel’s brutal genocide in Gaza since the start. The common tactic has been to conflate criticism of Israel, the IDF or Zionism with antisemitism - sometimes all three at once.
Crying wolf and who wants to be tarred with that brush?
It’s textbook common tactic but not only that the world is actually opening it’s eyes and getting wise to it.
This ruling goes one step further than that. It gives a legal anchor for protestors to prove their protests are NOT antisemitic or breaking any of the rapidly moving protest laws in Australia.
Perhaps the pro-Israel lobby in Australia will develop a new playbook or apologise for incorrect accusations of antisemitism from the past?
Perhaps not…
If only those pesky Judges were less verbose, eh?
EPILOGUE: What’s next? Upcoming cases
The Hadad case is an indisputably critical milestone - giving the differentiation of Zionism, criticism of Israel and the IDF from antisemitism.
Technically - it doesn’t actually determine IF that criticism of Zionism itself is antisemitic. The Judge was technically determining that Hadad was addressing “Zionists” rather than all Jewish people.
The next cases involve looking specifically whether the criticism of ZIONISM itself is antisemitic.

Pro-Israel Lobby: arguments Zionism criticism is antisemitic
The argument that the pro-Israel lobby in Australia make ad naseum is that:
virtually all Jewish people are Zionists … so an attack on Zionism is de facto an attack on them
calling for the “destruction” of the State of Israel is not only genocidal but antisemitic (hence the convenient IHRA definition of antisemitism which specifically calls this out - noting this was introduced 2016 in the wake of the 2014 Operation Protective Edge atrocities)
Dealing with those in turn:
Virtually all Jewish people are Zionists
Irrelevant.
Even that were true - which clearly it is not from opinion in Australia - the judge has established that Zionism is a “philosophy or ideology” and not an ethnic group.
So there’s no attack on someone’s identity.
That would be like saying you are calling out [insert ethnic group here] for supporting the Liberal Party or Veganism…
Louise Katz’s open letter to the NSW Jewish Board of Deputies who intervened to deplatform her for speaking out on Israel’s actions is a cutting review of Zionism v Judaism and worth a read4.
“Destruction” of the State of Israel
I don’t understand how this is antisemitic short of “because we say it is” by the IHRA definition of antisemitism.
the “right to a homeland and self determination” is invalid if that land was stolen in the first place, ceasing territory, ignoring UN resolutions to give back and using the system of Zionism has since then provided a creeping blockade of any two-state solution through illegal settlements. There is no right - the “homeland” plan was always a Greater Israel - the quiet bit Netanyahu is saying out loud now.
summed up as settler / colonialism - the exact model Israel has been implementing since 1948 - this must end
the laws making Israel a “Jewish” state are apartheid in themselves and furthermore it is NOT a “Jewish” state - with 2M Arabs out of 9M and the multi-cultural aspect that Israel keeps stressing
nobody is calling for murder of any Israelis. The are calling for dismantlement of the current political system and rebuilding as a fair non-apartheid single state democracy. There is no destruction - rebuilding. It’s like the dismantlement of apartheid South Africa with reunification. Practically there is hatred on both sides - peacekeeping activities will need to be in place but that is standard in conflict resolution to prevent such clashes.

Selected comments from ruling Federal Court of Australia Wertheim v Haddad [2025] FCS 7205 (further commentary from Abraham Edwards on Medium6).
The following sections of the ruling is where the judge has ruled FOR Haddad - e.g. his words were not antisemitic despite ECAJ’s claims. The Judge goes in to some surrounding context as to why in each case which is illuminating. In particular when contrasted with the sections where the Judge ruled that the words were antisemitic - as he says - that the reasonable person would consider them to be antisemitic.

Ruling
[106] The passages of the sermon that the applicants rely on as establishing this imputation contain critical statements about Zionists and Israel, but not about Jews per se. Mr Haddad says in those passages that “certain media outlets owned ... by the Zionist entities are trying to sway public perception” (ST23:10-11). He speaks of “the terrorist state of Israel and its mass murdering machine, the IDF” (ST23:11-12). He says that “right wing politicians have stepped into backing Israel because Israel holds their leash” (ST23:16-17) and that “Zionist backed media agencies” dragged him and the Centre “through the mud” (ST27:13-16). The only mention of Jews is in a comparison that he draws between the “dirty games” of certain present-day media and the Nazi media “before the Jewish genocide” (ST27:20-21). He says that “the media is preparing the same ground once again but this time for a Muslim genocide” (ST27:21-22).
[107] I do not consider that the ordinary, reasonable listener would understand Mr Haddad in these passages, either in isolation or in the context of the sermon as a whole, to be saying anything about Jews generally or about all Jews. He is quite specific in the sermon. He is critical of Israel, the IDF and Zionists. As mentioned, Jews are only mentioned in relation to the Holocaust, and not in a critical or disparaging way. It is only if the ordinary, reasonable listener heard the sermon in the knowledge of what Mr Haddad had said in Speech A that they might conclude that the references to Zionists was a reference to all Jews because of what he says about Zionists in Speech A. But that is not how Speech B is to be understood. The ordinary, reasonable listener would understand that not all Jews are Zionists or support the actions of Israel in Gaza and that disparagement of Zionism constitutes disparagement of a philosophy or ideology and not a race or ethnic group. Needless to say, political criticism of Israel, however inflammatory or adversarial, is not by its nature criticism of Jews in general or based on Jewish racial or ethnic identity: see South African Human Rights Commission on behalf of South African Jewish Board of Deputies v Masuku [2022] ZACC 5; 2022 (4) SA 1 (CC) at [4]-[6] and [161]-[166] per Khampepe J for the Court. Indeed, the applicants did not submit that it is. The conclusion that it is not antisemitic to criticise Israel is the corollary of the conclusion that to blame Jews for the actions of Israel is antisemitic; the one flows from the other.
[110] In the passage relied on by the applicants, Mr Haddad refers to a time in the future when Palestine is “cleansed from the filth of the Zionists” (ST26:18-21). Once again, this would not be understood by the ordinary, reasonable listener to be a reference to Jews generally. The context is the Israeli occupation of Palestine, in particular Gaza. Mr Haddad is speaking to a time in the future when Palestine is no longer occupied. That is not about Jews.
[116] The reference to “murdering cowards” is not to Jews. It comes in a discussion of the media that were critical of Speech A in which the words and actions of Israeli Prime Minister Benjamin Netanyahu, United States Senator Lindsey Graham, Israel’s Defense Minister (who was reported as having said that Israel would impose a complete siege of Gaza) and Prime Minister Morrison are discussed (ST31:14-33:13). They are all cited as not supporting a cease fire in Gaza and the media not being “worried” about them. In that context, it is clear that Mr Haddad is saying that the media that are “worried” about him and Mr Ismail, but not the officials that he mentions, are “murdering cowards” and “hypocrites”.
[133] In the first answer that is given by Mr Haddad (ST55:32-40), he says that there is no proof to support footage shown by the IDF that Hamas beheaded 40 babies during its attack on Israel. He says, “how can we believe the people that are known to be liars?” He is clearly saying that the IDF are known liars. He would not be understood as speaking about Jews generally.
[134] In the second answer (ST60:17-21), Mr Haddad says that the media that are owned by “the Zionists” will always push the narrative that the Israelis have done nothing wrong and that it is always the Muslims of Gaza who have done wrong and who deserve to be killed. Again, there is nothing in what Mr Haddad says there that would be understood as a reference to Jews generally. He is talking explicitly about Zionists.

APPENDIX E: An anti-Zionist Jewish Australian Judge
The previous Attorney-General of Australia Mark Dreyfus is a staunch Zionist. Indeed - he attacked pro-Palestine protestors asserting somewhat arrogantly:
“they’re not really saying Zionist - they’re saying Jew”
Ironically, Dreyfus’s constituency of Isaacs is named after a Jewish anti-Zionist Sir Isaac Alfred Isaacs, a previous Attorney-General, Chief Justice and 9th Governor General of Australia and author of the 1946 book “Political Zionism: Undemocratic, Unjust, Dangerous”.
This was a warning to the United Nations who were deliberating “the Palestine Question” NOT to partition Palestine and allow unlimited immigration two years before the actual partition… His essay reads like a prophecy.
I doubt Sir Isaacs would be in any confusion between Judaism and Zionism.
And one of his successor colleagues has just established that for us.
